1. Acceptance of services
These terms apply to appliance diagnostic and repair services provided by Homesync Co, operating as HomeSync Appliance Repair (the “Company”). By scheduling service, authorizing diagnostic work, allowing a technician to perform work, or paying any portion of an invoice after these terms have been made available to you, you agree to these terms, subject to applicable law. Any separately signed service agreement controls where it expressly conflicts with these terms.
2. Limited parts and labor warranty
- Installed parts are warranted against defects in materials for one (1) year from installation.
- Labor performed is warranted for ninety (90) days from service.
Coverage applies only to the specific parts installed and labor provided by the Company. It does not cover failures caused by misuse, abuse, neglect, improper operation, power surges, accidents, acts of nature, normal wear and tear, or pre-existing conditions unrelated to the repair.
To request warranty service, contact us promptly within the applicable warranty period and provide the original invoice or sufficient information for us to verify the service. The appliance must be safely accessible. Damage caused by tampering or repairs by others is not covered; unrelated third-party work does not automatically void rights protected by law.
Covered warranty repairs will be performed without charges for covered parts or covered labor. The applicable coverage period determines whether a part, labor, or both are covered. In particular, after the 90-day labor period, labor for a covered replacement part may be chargeable, with the amount disclosed and approved before work begins, unless a written agreement or applicable law requires otherwise.
This is a limited warranty, not a guarantee that unrelated components will not fail. No additional express warranty is provided except as stated in a written Company agreement. Any attempted limitation of implied warranties, including merchantability or fitness for a particular purpose, applies only where legally permitted. Nothing in these terms excludes, limits, or waives nonwaivable implied warranties or consumer remedies. You may have additional rights that vary by state.
3. Refusal or discontinuation of service
A technician may refuse or discontinue service if, in their professional judgment, the appliance or work area is unsafe, including electrical hazards, gas leaks, or structural problems; repairs are not economical compared with the appliance’s value; or necessary parts are obsolete or unavailable. Previously disclosed diagnostic or service-call fees remain payable for services performed, subject to applicable law.
4. Liability limitations and disclaimers
To the fullest extent permitted by law, the Company and its technicians disclaim liability for direct, indirect, incidental, consequential, special, and punitive damages arising from service, including loss of appliance use; food spoilage or loss; water damage, flooding, leaks, or related property damage before, during, or after testing or repair; cosmetic scratches, dents, scuffs, or marks to appliances, flooring, countertops, cabinets, walls, or surrounding areas; damage to personal property, fixtures, or premises; business interruption; lost profits; and inconvenience.
These exclusions do not apply to the extent prohibited by law, including liability that cannot lawfully be excluded for negligence, gross negligence, reckless or intentional misconduct, personal injury, or violations of consumer-protection law. They do not excuse breach of an enforceable warranty.
The Company is not responsible for pre-existing defects or damage merely discovered during service, or subsequent issues caused by customer misuse, improper installation by others, or normal wear and tear, except to the extent the Company is legally responsible.
Parts may be new, remanufactured, refurbished, or reconditioned. The type of part will be disclosed before installation when required by law or material to customer approval. No representation beyond the stated warranty is made except as required by law or expressly agreed in writing.
To the extent legally permitted, total liability for a claim will not exceed the amount paid for the specific service giving rise to that claim. Beyond the stated limited warranty, services are provided “as is” only to the extent permitted by law. Neither this cap nor the “as is” language limits nonwaivable rights or remedies.
5. Estimates, fees, and payment
Estimates are approximate and may change if additional problems are discovered. Customer approval is required before any increase exceeding 10% of the original estimate. Where law requires approval for a smaller increase, additional work, or a revised estimate, that requirement controls. An estimate does not authorize unrelated additional repairs.
Unless a different fee or an applicable written membership benefit is disclosed and agreed before scheduling, the diagnostic/service-call fee is $75 and is credited toward an approved repair. The disclosed fee applies even if repairs are declined or not performed, subject to applicable law. Payment is due when service is completed unless otherwise agreed in writing.
6. Customer responsibilities
- Provide safe, clear access to the appliance and a suitable work area.
- Keep pets and children away from the work area and remove or secure valuables.
- Empty the appliance and disconnect it only when instructed and safe to do so; do not handle gas or electrical connections beyond your ability.
- Disclose known hazards, leaks, prior repairs, and relevant operating problems.
7. Memberships and separate written benefits
These are the standard service terms. Any separately purchased VIP membership must have its price, renewal, cancellation, benefits, and warranty terms disclosed before purchase. An expressly promised longer warranty or other membership benefit is not reduced by these standard terms. These terms do not independently authorize recurring charges.
8. Consumer rights and severability
Nothing here waives rights or remedies that applicable law does not permit a consumer to waive. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Changes to these terms apply prospectively and do not retroactively reduce existing warranty coverage.
